Second company, Hurricane Industrial Equipment, still faces eight charges

Charges dropped against one company over workplace accident

Charges were dropped against one of two companies accused of violating the Occupational Health and Safety Act in Newfoundland and Labrador, in relation to an industrial accident that seriously injured a man.

The incident happened in July of 2020 while the man was working for Hurricane Industrial Equipment, which is based in Nova Scotia.  He was performing maintenance repairs to a 7-tonne forklift at a property in Newfoundland owned by Blue Water Agencies of C.B.S. 

While doing the repairs, a part fell on the man, seriously hurting him and leaving him with a partially severed hand. 

Both Hurricane Industrial and Blue Water were charged, but local media outlet VOCM reports the Crown has withdrawn all of the charges against Blue Water. The Crown is proceeding with eight charges against Hurricane Industrial.

The company is accused of failing to provide a safe workplace as well as proper tools and instructions, and failing to safely block an elevated piece of equipment. Hurricane Industrial allegedly used a jack to block it, which is against the law.

The case is expected to be back in court on March 6th.
